Welcome to Sathiclap ("we," "our," or "us"), an online marketplace platform that bridges customers with service providers across India. These Terms and Conditions ("Terms") govern your use of our website, mobile application, and services (collectively, the "Platform").

  • "User": Any person accessing or using the Platform, including both Customers and Service Providers

  • "Services": Any service category available on the Platform including but not limited to home services (AC repair, plumbing, electrical), personal services (tutoring, fitness), beauty services, appliance repair, cleaning, and specialized solutions
  • "Custom Requirements": Feature allowing customers to post specific project requirements for competitive bidding by multiple service providers
  • "Booking": Confirmed appointment between Customer and Service Provider through the Platform
  • "Platform": Sathiclap website, mobile applications, and all related services
  • "Content": All text, graphics, images, music, software, audio, video, works of authorship, and other materials posted on the Platform

3. PLATFORM OVERVIEW AND NATURE OF SERVICES

3.1 Platform Role

Sathiclap operates as an online intermediary marketplace that bridges customers with verified service providers. We are a technology platform that enables:

  • Connection between service seekers and service providers
  • Secure communication channels
  • Booking and scheduling systems
  • Payment gateway integration
  • Review and rating mechanisms
  • Custom project requirement postings and competitive bidding

3.2 Important Disclaimers

Sathiclap is NOT a service provider. We:

  • Do not employ service providers - they are independent contractors/businesses
  • Do not provide services directly to customers
  • Act solely as a facilitator and technology platform
  • Enable transactions but are not party to the service contract between Customer and Service Provider
  • Do not control the quality, timing, legality, or any other aspect of services provided

3.3 Service Provider Relationship

  • Service Providers are independent contractors, not employees of Sathiclap
  • All service-related contracts are directly between Customer and Service Provider
  • Service Providers set their own service standards, pricing (within platform guidelines), and availability
  • Sathiclap provides the platform infrastructure but does not direct how services are performed

4. USER ELIGIBILITY

4.1 You must be at least 18 years old to use this Platform
4.2 You must provide accurate, current, and complete information
4.3 You must be a legal resident of India
4.4 Service Providers must have valid licenses/permits as required by law

5. USER ACCOUNTS

5.1 Registration: You must create an account to access certain features
5.2 Account Security: You are responsible for maintaining account confidentiality
5.3 Accurate Information: You must provide truthful and updated information
5.4 Account Termination: We reserve the right to suspend/terminate accounts for violations

6. CUSTOMER OBLIGATIONS

6.3 Pay agreed fees promptly
6.4 Treat service providers respectfully
6.5 Provide honest reviews and ratings
6.6 Comply with all applicable laws

7. SERVICE PROVIDER OBLIGATIONS

7.2 Provide services professionally and timely
7.3 Maintain insurance coverage as required
7.4 Honor quoted prices and timelines
7.5 Comply with safety standards and regulations
7.6 Respond to customer communications promptly

8. BOOKING AND SERVICE TERMS

8.1 Service Booking Process

  • Customers can browse services or post custom requirements
  • Service Providers can accept bookings or submit bids for custom projects
  • Booking confirmation creates a direct service contract between Customer and Service Provider
  • Sathiclap facilitates but is not a party to this contract

8.2 Service Standards and Quality

  • Service Providers must maintain professional standards
  • Customers have the right to expect services as described
  • Disputes regarding service quality are primarily between Customer and Service Provider
  • Sathiclap may assist in resolution but is not liable for service outcomes

8.3 Cancellation and Rescheduling

  • Cancellation policies vary by service category and are clearly displayed
  • Both parties may cancel with appropriate notice and potential penalties
  • Emergency cancellations may be subject to different terms
  • Repeated cancellations may result in account restrictions

8.4 No-Show and Missed Appointments

  • Service Providers must honor confirmed bookings
  • Customers must be available at scheduled times
  • No-show penalties may apply to both parties
  • Alternative resolution mechanisms will be provided

9. CUSTOM REQUIREMENTS AND BIDDING SYSTEM

9.1 Custom Requirements Feature

  • Customers can post detailed project requirements for services not covered by standard offerings
  • Examples include specialized installations, custom home improvements, unique tutoring needs, etc.
  • Requirements must include clear project descriptions, timelines, and budget expectations

9.2 Bidding Process

  • Verified Service Providers can submit competitive proposals
  • Bids should include detailed pricing, timeline, and service approach
  • Customers can review multiple bids and communicate directly with providers
  • Final selection and contract terms are solely between Customer and chosen Service Provider

9.3 Platform Role in Custom Projects

  • Sathiclap provides the technology platform for requirement posting and bid management
  • We facilitate communication but do not mediate contract terms
  • Payment processing (where applicable) follows standard platform procedures
  • Project success and completion are the responsibility of contracting parties

10. PAYMENT TERMS

10.1 Payment Methods and Processing

  • Payments accepted through integrated payment gateways
  • All prices displayed in Indian Rupees (INR)
  • Payment methods include digital wallets, UPI, credit/debit cards, and net banking
  • Payment processing is handled by third-party certified payment processors

10.2 Pricing and Fees

  • Service prices are set by Service Providers within platform guidelines
  • Platform commission and convenience fees as applicable and disclosed
  • All taxes including GST will be calculated and displayed at checkout
  • Promotional discounts and offers as available and subject to terms

10.3 Payment Security

  • We use industry-standard encryption for payment processing
  • Card details are not stored on our servers
  • PCI DSS compliant payment handling through certified processors

10.4 Refunds and Disputes

12. DISCLAIMERS AND LIMITATION OF LIABILITY

  • Service Provider Verification: While we conduct basic verification, we do not guarantee Service Provider qualifications or performance
  • Platform Availability: The Platform may experience downtime for maintenance or technical issues
  • Third-Party Content: User reviews, ratings, and content reflect individual opinions only
  • External Links: We are not responsible for third-party websites or services

12.2 No Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.3 Limitation of Liability

  • Sathiclap's maximum liability is limited to the platform fees actually paid by the user
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not liable for service-related damages, injuries, or losses
  • Force majeure events are beyond our control and responsibility

12.4 Service Provider Responsibility

Service Providers are solely responsible for:

  • Service quality and professional standards
  • Safety measures and insurance coverage
  • Compliance with applicable laws and regulations
  • Any damages or injuries resulting from their services

13. INDEMNIFICATION

You agree to indemnify and hold Sathiclap harmless from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

14. DISPUTE RESOLUTION AND GRIEVANCE HANDLING

14.1 Internal Grievance Resolution

  • First Contact: All disputes should first be reported through our customer support
  • Response Time: We will acknowledge grievances within 24 hours
  • Resolution Timeline: Most disputes resolved within 7-14 business days

  • Service Quality Disputes: Between Customer and Service Provider
  • Payment Disputes: Billing, refunds, and transaction issues
  • Platform Issues: Technical problems, account access, policy violations
  • Custom Project Disputes: Contract and delivery issues for custom requirements

14.3 Alternative Dispute Resolution

  • Mediation: Good faith attempt at mediation for significant disputes
  • Arbitration: Binding arbitration under Arbitration and Conciliation Act, 1996
  • Arbitration Venue: Hajiupur,Bihar, India
  • Language: Proceedings conducted in English/Hindi

14.4 Governing Law and Jurisdiction

  • These Terms are governed by the laws of India
  • Subject to arbitration clause, courts in Hajipur,Bihar, India have exclusive jurisdiction

15. TERMINATION

15.1 Either party may terminate account with notice
15.2 We may terminate immediately for violations
